PAX Technology, Inc. Privacy Policy

1. Introduction

This Privacy Policy of PAX Technology, Inc. (“PAX”) outlines the privacy practices regarding the Processing of Personal Data, including Personal Data accessed in connection with the provision of products and services to our customers. This policy applies globally to all operations of PAX and its affiliates where PAX serves as the Controller of Personal Data. PAX is dedicated to ensuring the security and transparency of Personal Data in accordance with applicable laws and contractual obligations.

2. Definitions

For the purposes of this Privacy Policy, the terms listed below shall be defined as follows:

  • Personal Data: Information relating to an identified or identifiable natural person, to the extent such information is protected under applicable law, including but not limited to name, address, email address, or online identifiers. In the state of California, this may also encompass identifiers, payment card numbers, Protected Class characteristics, commercial information, biometric data, professional or educational information, Internet activity, and inferences used to create consumer profiles, as defined by local regulations.
  • Contract Data: Personal Data pertaining to our customers, their customers, or their personnel that PAX Processes pursuant to a contractual agreement with a customer.
  • Controller: PAX Technology, Inc., or its affiliates, which determines the purposes and means of Processing Personal Data.
  • Process: Any operation or set of operations performed on Personal Data, whether automated or manual, including collection, recording, organization, storage, adaptation, retrieval, use, disclosure, alignment, restriction, erasure, or destruction.
  • Processor: A natural or legal person, public authority, agency, or other entity that Processes Personal Data on behalf of the Controller.
  • Special Categories: Personal Data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic or biometric data for unique identification, data concerning health, disability, age, or a natural person’s sex life or sexual orientation, as designated under applicable law.

The term “You” refers to any individual about whom PAX collects, uses, or discloses Personal Data, except as otherwise specified.

3. Collection of Personal Data

The categories of Personal Data collected by PAX vary depending on your relationship with us (e.g., customer, user, employee, or visitor) and the requirements of applicable law. Personal Data may be provided by you or collected as follows:

  • Account Creation: Registration for an online account or event may require submission of your name, title, company, physical and email addresses, telephone number, social security number, tax identification number, financial account information, user IDs, and/or password.
  • Communication: Contacting PAX to join a mailing list, inquire about or purchase a product or service, apply for employment, complete an information form, or submit a question, comment, or request may involve providing your name, title, company, physical and email addresses, telephone number, resume, user IDs, and/or password.
  • Survey Participation: Voluntary participation in surveys may involve the provision of certain Personal Data.
  • Facility Visits: When visiting PAX physical facilities, Personal Data may be collected for security purposes, including through closed-circuit television (CCTV) recordings that may capture your image.
  • Contractual or Business Relationships: Entry into a contract or business relationship may necessitate the collection of contact information, financial data, and other relevant data to manage the relationship, process orders, deliver products or services, or resolve complaints and disputes.
  • Sweepstakes or Contests: Provision of contact information for sweepstakes or contests may be used to notify winners or for promotional purposes where permitted by law. In certain jurisdictions, winner information may be disclosed publicly as required.
  • Information from Other Sources: PAX may obtain Personal Data from third parties, including app stores, login services, or social networking sites, to supplement or verify information you provide. This may include name, user identification number, username, location, gender, birth date, email, profile picture, or contacts, subject to your privacy settings on those platforms.
  • Automatic Data Collection: PAX may automatically collect data via technologies such as cookies, including your Internet protocol (IP) address, user settings, device identifiers, browser details, location information, pages visited, and interaction patterns. Such data may be associated with your account or devices and combined with information from other sources.

PAX may employ tools such as cookies, web beacons, and APIs/SDKs to enhance user experience, as detailed in Section 8.

4. Social Networking and Public Interactions

  • Social Networking Tools: In the event that PAX utilizes social networking widgets or tools to disseminate information, your Personal Data shall be subject to the terms of use and privacy policies of the respective social networking platform.
  • Engaging on Social Media: PAX may provide forums, blogs, or social media pages. Content submitted by you on these channels shall be deemed “public” and will not be afforded privacy protections under this Privacy Policy.

5. Use of Personal Data

PAX collects and Processes Personal Data for specified, legitimate purposes, ensuring compatibility with such purposes. The following uses are authorized:

  • Fulfilling Business Transactions: PAX may utilize your Personal Data to execute business transaction requests, including maintaining or servicing accounts, verifying customer information, processing payments, providing advertising and marketing services, conducting analytics, performing internal research for technological development, delivering products or services (including notifications of issues, fixes, or updates), or responding to your inquiries. For suppliers, this may include issuing purchase orders, receiving invoices, or sharing forecasts. Telephonic or electronic communications (e.g., email, online chat) for support purposes may be monitored or recorded for quality assurance, training, or documentation.
  • Recruitment: In the context of employment applications, PAX may collect information such as resumes and utilize automated processing techniques for qualitative scoring or ranking, overseen by Human Resources personnel. Such data may be retained for future consideration, legal compliance, or as outlined herein or in separate notices.
  • Sales and Marketing: PAX may Process your Personal Data for sales, marketing, customer satisfaction surveys, market research, event notifications, or product information dissemination. You may modify your preferences as described in Section 14.
  • Contract Data: When Processing Contract Data on behalf of customers, PAX adheres to customer instructions and their respective privacy policies.
  • Deidentified Data: Aggregated, anonymized data, no longer identifiable to individuals, may be used for research, development, statistical analysis, or service improvement.
  • Automated Decision-Making: Statistical techniques and profiling may be employed to enhance product quality, screen employment candidates, ensure legal compliance, or protect IT infrastructure, in accordance with applicable law.

Lawful Bases for Processing: PAX Processes Personal Data where reasonably necessary to:

  • Perform a contract with you or undertake preparatory steps at your request.
  • Comply with regulatory or legal obligations.
  • Protect your vital interests or those of another natural person.
  • Fulfill a task in the public interest.
  • Obtain your consent, which may be withdrawn as outlined below.
  • Pursue a legitimate interest of PAX or a third party, including security enhancements or resource optimization.

6. Sharing of Personal Data

We don’t “share” your Personal Information, as defined in the California Consumer Privacy Act (“CCPA”). PAX may disclose your Personal Data to the following categories of third parties:

  • Affiliates: Personal Data may be shared within the PAX corporate group.
  • Service Providers: Third-party suppliers and service providers, including IT vendors, customer service providers, and consultants, may receive Personal Data under contracts requiring compliance with PAX policies and applicable law.
  • Business Partners: Personal Data may be provided to partners with whom PAX jointly offers products or services.
  • Advertising Partners: PAX does not host advertisements on its websites; however, PAX may engage third parties to collect information about your online activities (e.g., IP address, pages visited) across multiple sites, including PAX websites, to deliver targeted advertisements. Such activities are governed by the third parties’ privacy policies, and you may opt out as described below.
  • Mergers or Sales: In the event of business development activities such as sales, mergers, or reorganizations, Personal Data may be disclosed to prospective or actual purchasers, with appropriate safeguards.
  • Legal Disclosures: Personal Data may be released to third parties, including law enforcement or government officials, when required or permitted by law, to protect PAX’s rights, property, or safety, or those of customers, partners, suppliers, or others, or to enforce policies, collect debts, or investigate illegal activity.

7. Transfers of Personal Data

As a global entity, PAX may transfer Personal Data from the country of collection to other jurisdictions to facilitate business transactions or fulfill the purposes outlined above. PAX will take all reasonable legal, technical and organizational measures to ensure that if Personal Data is transferred outside of the country of collection, it will be treated securely and with an adequate level of protection compared to the level of protection offered in the country of collection. Where such transfers occur from a country deemed by the exporting jurisdiction (“Exporting Country”) to lack adequate data protection, PAX shall implement standard contractual clauses, as issued by the European Commission or other relevant data protection authorities, to ensure a comparable level of protection.

8. Cookies and Tracking Technologies

  • Cookies: PAX may deploy cookies—small data elements sent to your web browser and stored on your device—to enhance website functionality, personalize your experience, or evaluate marketing effectiveness. You may manage cookie settings via your browser, though disabling them may limit certain features. Additional information is available at www.allaboutcookies.org/manage-cookies/.
  • Other Technologies: PAX and its service providers may utilize web beacons, log files, Flash cookies (local shared objects), and analysis tools (e.g., Google Analytics, Adobe Analytics) to monitor website usage. Opt-out options are available at http://tools.google.com/dlpage/gaoptout for Google Analytics and http://www.adobe.com/privacy/opt-out.html for Adobe Analytics.
  • APIs and SDKs: Third-party application programming interfaces (APIs) and software development kits (SDKs) may be used, enabling analytics or advertising partners to collect Personal Data for tailored content. Further details may be obtained by contacting PAX as specified in Section 14.
  • Do Not Track: PAX does not currently respond to or honor Do Not Track (DNT) signals or similar mechanisms transmitted by web browsers.

9. Your Privacy Rights and Choices

You are afforded certain rights and choices regarding your Personal Data, subject to applicable law:

  • Preferences: You may opt out of marketing communications by following unsubscribe instructions in emails or contacting PAX directly. For mobile push notifications or location data collection, adjust your device settings.
  • Access and Correction: You may request access to your Personal Data or seek corrections where inaccurate or incomplete. PAX may charge a reasonable fee if permitted by law, and for Contract Data, the relevant customer is the Controller. Self-service tools may be available, or PAX will refer you to the appropriate Controller.
  • Deletion or Restriction: You may request deletion of Personal Data where required by law, subject to exceptions, or restrict Processing (e.g., during accuracy verification or for legal claims), with prior notification before resuming Processing.
  • Opt-Out of Targeted Advertising: Manage preferences via www.youronlinechoices.eu/, https://youradchoices.ca/choices/, www.networkadvertising.org/managing/opt_out.asp, or www.aboutads.info/choices/. For mobile apps, use Digital Advertising Alliance’s AppChoices or device platform controls.
  • Appeals: If a request is denied (e.g., due to excessiveness or repetition), you may appeal using the contact methods in Section 14.
  • Consent Withdrawal: Where consent was previously provided, you may withdraw it at any time without affecting prior lawful Processing, unless compelling legitimate grounds or legal claims necessitate continued use.
  • U.S. State Specific Disclosures: This section applies to our privacy practices as required under U.S. State specific privacy laws including, but not limited to, the follow: California Consumer Privacy Act, including as amended by the California Privacy Rights Act (together, the “CCPA“), Colorado Privacy Act, Connecticut Data Privacy Act, Virginia Consumer Data Protection Act and Utah Consumer Privacy Act.

PAX may undertake reasonable steps to verify your identity prior to acting on requests to safeguard your privacy.

10. Protection of Personal Data

PAX is committed to implementing robust data privacy measures to protect Personal Data. These efforts are designed to comply with applicable laws, contractual obligations, and industry standards, minimizing access and use to what is reasonably necessary.

11. Retention of Personal Data

Personal Data shall be retained by PAX only for the duration necessary to fulfill the purposes for which it was collected, or as required to comply with legal obligations, resolve disputes, protect assets, or enforce rights and agreements. PAX employs measures to limit access, use, and retention to the minimum extent required.

12. Children’s Information

PAX’s applications and websites are not intended for individuals under the age of 16. By using these platforms, you affirm that you are at least 16 years of age. PAX does not sell or share Personal Data of consumers under 16. Parents or guardians believing a child has provided Personal Data without consent should contact PAX as outlined in Section 14. If we obtain actual knowledge that we have collected personal data from an individual under the age of 16, we will delete relevant data as soon as possible once we are made aware of it.

13. Changes to This Privacy Policy

PAX reserves the right to amend this Privacy Policy at any time based on changes in business, technology, applicable law, and good practice, with an updated version published on our website. In the event of material changes affecting the use or sharing of previously collected Personal Data, PAX shall provide you with an opportunity to consent to or opt out of such changes prior to their application, in compliance with applicable law. Such changes to Privacy Policy will apply from the effective date specified in the notice.
